CHILDREN EDUCATION ALLOWANCE (CEA)

Whether Reimbursement of Children Education Allowance (CEA) for 3rd child is permissible if CEA has not been claimed for 1st and or 2nd child? As per OM dated 2.9.2008 CEA is admissible for two school going children does it mean any two school going children?
As per OM No.12011/03/2008-Estt.(AL) dated 11.11.2008, the Children Education Allowance would be admissible for more than two children in case the number of children exceeds two as a result of the second child birth resulting in twins or multiple birth. This implies that the CEA will be admissible only in the case of two eldest surviving children and CEA for third or subsequent child will only be permissible if there is a case of multiple birth at the time of second child birth. Further, reimbursement of CEA for the 3rd child is admissible in case of failure of sterilization operation.

What are the fees that are reimbursable? Whether Development Fees, Annual Charges, Transportation Fees are reimbursable? Reimbursement towards purchase of school bag, water bottle, uniform, shoes and stationary is admissible?
As per OM No.1211/03/2008-Estt.(AL) dated 2.9.2008, tuition fee, admission fee, laboratory fee, special fee charged for agriculture, electronics, music or any other subject, fee charged for practical work under the programme of work experience, fee paid for the use of any aid or appliances by the child, library fee, games/sports fee and fee for extra-curricular activities are reimbursable subject to the condition that the aforementioned fee are charged by the school directly from the student. Besides, reimbursement for purchase of one set of uniforms prescribed by the school in which the child is studying, one pair of shoes, in an academic year are reimbursable. Uniform include all items of clothing prescribed for a day, as uniform by the school, irrespective of colours/winter/summer/PT uniforms.

Whether CEA has been increased by 25% as a result of enhancement of Dearness Allowances beyond 50%?
This Department's OM No. 12011/03/ 2008-Estt.(AL) dated 2.9.2008 clearly indicates that the limits "would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50% . There is no need for any separate order from this Department to effect enhancement of CEA as a result of increase in D A by 50%. However, O.M. No. 12011/01/2011-Estt.(Allowance) dated 4th May, 2011, has been issued to clarify this further.

Whether CEA can be claimed for the child for the same class twice?
The reimbursement of CEA is not linked to the performance of the child in his class. Even if a child fails in a particular class, the reimbursement is permissible. However, if the child is admitted in the same class in another school, although the child has passed out of the same class in previous school or in the mid- session, CEA shall not be reimbursable.

Whether Hostel subsidy is reimbursable irrespective of transfer liability?
Hostel Subsidy is reimbursable to all Central Govt, employees for keeping their ward in the Hostel of a residential school away from the station in which the employee is posted or residing irrespective of any transfer liability.

Whether the admissible amount on account of CEA can be reimbursed in full to a Govt. servant in the first quarter of the financial /academic year itself.
A Govt. servant is allowed to get 50% of the total amount subject to the overall annual ceiling in the first quarter and the remaining amount in third and or fourth quarter. Frontloading of the entire amount in the first and second quarters is not allowed.
7.
Whether any age limit has been prescribed for reimbursement of CEA in respect of children studying in nursery classes.
There is no minimum age prescribed for reimbursement of CEA in respect of children admitted in nursery classes. However, with regard to physically challenged children the minimum age of 5 (five) years has been prescribed. The maximum age for normal child is 20 years and for physically challenged children the maximum age is 22 years.
8.
Whether the school/institution should be recognized?
The school/institution has to recognized by the Central or State Government or UT administration or by University or a recognized educational authority having jurisdiction over the area where the institution is situated.
9.
Whether CEA is payable for the children of Central Government employees and studying abroad, including children of citizens of Nepal/Bhutan but working in Government of India, and the children are studying in the schools in their native place, i.e., Nepal/Bhutan?
The CEA is payable for the children of all Central Government employees including citizens of Nepal and Bhutan, who are employees of Government of India, and whose children are studying abroad. However, a certificate may be obtained from the Indian Mission abroad that the school is recognized by the educational authority having jurisdiction over the area where  the  institution  is  situated.

Dearness Allowance from Jan-2011:-

       The first additional installment of Dearness Allowance for this year from Jan-2011 has been announced today by the Union Cabinet.

As per the announcement, the Dearness Allowance is increased by 6% from 45% to 51% to Central Government Employees and Pensioners. The decision would also change the allowance structure.

There is no recommondations in 6th CPC that the Dearness Allowance crosses 50% would merge with baisc pay. But some allowances and advances will be increased by 25% on crossing of Dearness Allowance by 50%.

OFFICE MEMORANDUM

Subject : Special concession/facilities to Central Government Employees working in Kashmir Valley in attached / subordinate offices or PSUs falling under the control of Central Government.

The undersigned is directed to refer to this to this Department's O.M. No.18016/3/2012-Estt.(L) dated 27th January, 2011 on the subject mentioned above and to state that it has been decided to extend the package of concession/incentives to Central Government employees working in Kashmir Valley for a further period of one year w.e.f.01.01.2012 upto 31.12.2012. The revised package of incentives is as per annexure.

2. The package of incentives is uniformly applicable to all Ministries/Departments and PSUs under the Government of India and they should ensure strict adherence to the rates prescribed in the package. The concerned Ministry/Department may ensure implementation and monitoring of the package in conformity with the approved package, and therefore, all Court cases in which verdicts are given contrary to the package would have to be contested by the Ministries/Departments concerned.

DETAILS OF PACKAGE OF CONCESSIONS/FACILITIES TO CENTRAL GOVERNMENT EMPLOYEES WORKING IN KASHMIR VALLEY IN ATTACHED / SUBORDINATE OFFICES OR PSUs FALLING UNDER THE CONTROL OF CENTRAL GOVERNMENT.

[Kashmir Valley comprises of ten districts namely, Anantnag, Baramulla, Budgam, Kupwara, Pulwama, Srinagar, Kulgam, Shopian, Ganderbal and Bandipora]

I. ADDITIONAL H.R.A. AND OTHER CONCESSIONS:

(A) Employees posted to Kashmir Valley:
(i) These employees have an option to move their families to a selected place of their choice in india at Government expense. T.A. for the families allowed as admissible in permanent transfer inclusive of transportation of personal effects, lump-sum payment for packing etc.

(ii) Departmental arrangements for stay, security and transportation to the place of work for employees.

(iii) HRA as for Class ‘Y’ city applicable for employees exercising option at (1). Such employees will be eligible for drawing the normal HRA as well at their place of posting provided Departmental arrangement is not made for his/her stay.

(iv) The period of temporary duty extended to six months. For period of temporary duty daily allowance at full rate is admissible, apart from departmental arrangements for stay, security and transportation.

(B) Employees posted to Kashmir Valley who do not wish to move their families to a selected place of residence:

A per diem allowance of Rs.l0/- is paid for each day of attendance to compensate for any additional expense in transportation to and from office etc. This will be in addition to the transport allowance, which the employee is otherwise eligible for under Ministry of Finance order No. 2l(2)/2008-E.II(B) dated 29.08.2008.

II. MESSING FACILITIES:
Messing Allowance to be paid to the employees of a uniform rate of Rs. 15/- per day by all Departments, or in lieu messing arrangements to be made by the Departments themselves. This rate of allowance will have to be adhered to uniformly by all the Ministries/Departments with effect from 01.07.1999. The slightly higher rate of Rs.25.50/- adopted by the Department of Telecom and Posts and allowed to be continued as a special case by the Department of Personnel in consultation with the Ministry of Finance, would, however, continue to be paid at the said rate.

III. PAYMENT OF MONTHLY PENSION TO PENSIONERS OF KASHMIR VALLEY:
Pensioners of Kashmir Valley who are unable to draw their monthly pensions through either Public Sector Banks or PAO treasuries from which they were receiving their pensions, would be given Pensions outside the Valley where they have settled, in relaxation of relevant provisions.

NOTE :- 1. The package e of concession/facilities shall be admissible in Kashmir Valley comprising of ten districts namely, Anantnag, Baramulla, Budgam, Kupwara, Pulwama, Srinagar, Kulgam, Shopian, Ganderbal and Bandipora.

2. The package of concessions/facilities shall be admissible to Temporary Status Casual labourers working in Kashmir Valley in terms of Para 5(1) of the Causal Labourers (Grant of Temporary Status and Regularization) Scheme of Government of India, 1993.

3. The benefit of additional HRA admissible under the Kashmir Valley package shall be admissible to all Central Government employees posted to Kashmir Valley irrespective of whether they are natives of Kashmir Valley, if they choose to move their families any where in India subject to the conditions governing the grant of these allowances.

4. The facilities of Messing Allowance and Per Diem Allowance shall also be allowed to natives of Kashmir Valley in terms of the Kashmir Valley package.

EXPECTED DEARNESS ALLOWANCE FROM JULY 2012

Expected DA from July 2012
Perhaps it is very early to calculate the status of  additional Dearness allowance from July, 2012 for Central Government employees and Pensioners, before releasing the AICPIN for the balance of two months i.e.May and June. Enquiries are being poured as comments and received emails to our inbox about the expected DA from July, 2012. We can assume that the AICPIN will certainly go up, because of the essential commodities prices are going high with non stop. Anyway we can assume the additional Dearness allowance from July 2012 will be minimum 7%. The existing Dearness allowance is 65%, it will become as 65% + 7% = 72%.
